Terms of Service

These terms apply when you use this website. When you engage us for a project, the signed proposal or service agreement for that project takes precedence over anything on this page.

1. Who you are contracting with

Notices under these terms should be sent to website@hostingke.co.ke.

2. Using this website

You may read, print and share the pages on this site. You may not scrape it at a volume that degrades it for other visitors, attempt to access the admin area or the database, or submit the forms automatically.

3. Quotes and estimates

The quote builder gives an estimate, not an offer. It is calculated from the options you select and the published rates, and it is valid for 30 days. The final price depends on the scope we agree after talking to you, and we will put that in writing before any work starts. Prices shown are in Kenya Shillings and exclude 16% VAT, which is added to your quote.

A quote issued through our client portal is a formal offer on the terms shown on it. It becomes a contract when you accept it in the portal.

4. Our services

Edgecom Web Solutions provides web design and development, custom software development, hosting and related support. The deliverables, milestones and timeline for each engagement are defined in that engagement's proposal. Where a timeline depends on you — content, approvals, access to your systems — delays on your side move the delivery date by the same amount.

5. Payment

Payment terms are set out in each proposal. Unless it says otherwise, projects are invoiced in stages, the first stage is payable before work begins, and invoices are due within 14 days. We accept M-Pesa and bank transfer. Work may be paused on accounts more than 30 days overdue, after written notice.

6. Refunds and cancellations

You can cancel a project at any time in writing. You pay for the work completed up to that point, and we hand over what has been built and paid for. Deposits cover work already scheduled and committed, so they are refundable only to the extent that work has not yet started.

Hosting and recurring subscriptions can be cancelled before the next renewal date; we do not pro-rate a period already paid for. Domain registrations cannot be refunded once registered, because the registry fee is non-recoverable.

If something we delivered does not do what the proposal said it would, tell us and we will fix it at no charge. That warranty runs for 30 days after handover unless the proposal gives a longer period.

7. Intellectual property

The content of this website — text, code samples, illustrations and the Edgecom name and logo — belongs to us or our licensors.

For client work, ownership of the custom code and designs we build for you transfers to you on final payment. Anything we bring to the project that existed beforehand — our internal libraries, tooling and our own products — stays ours, and you get a licence to use it as part of the delivered work. Third-party components keep their own licences.

8. Your content

You keep ownership of the text, images and data you give us, and you confirm you have the right to use them. You are responsible for the legality of the content you ask us to publish.

9. What we are liable for

We will do our work with reasonable skill and care. We are not liable for indirect or consequential losses — lost profit, lost data, or business interruption — and our total liability for any claim is limited to the fees you paid us for the specific service the claim arises from.

Nothing in these terms limits liability for fraud, or for anything that cannot be limited under Kenyan law.

10. Third-party services

Some links here go to services we run separately, including our client portal at clients.hostingke.co.ke. Those have their own terms, and buying through them is a contract with the entity named there.

11. Privacy

How we handle personal data is set out in our privacy policy, and which cookies we set is in our cookies policy.

12. Changes

We may update these terms. The version on this page at the time you engage us is the one that applies to that engagement.

13. Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction. Before going to court we will both try to settle a dispute by discussion.
